VACCINE MANDATE STATE ACTION
Coalition of Citizens for Medical Choice, Inc. et al v.
New York State Department of Health et al
… Petitioners urge this Court to set aside the New York State Department of Health regulation requiring vaccination for healthcare workers, as set forth in 10 NYCRR § 2.61, for the following reasons: (i) there is no present, medical emergency that justifies the enactment of the Department of Health’s regulations as it applies to healthcare workers employed throughout the State of New York; (ii) the penalty of termination of employment will not accomplish the stated goal; (iii) the Respondents have failed to make the requisite factual findings to invoke the emergency rulemaking procedure or none actually exist; (iv) the Respondents have failed to comply with New York State Administrative Procedure Act § 202; and (v) the Department of Health’s emergency regulation will impact more than 450,000 healthcare workers across the State, is an invalid exercise of the Department’s authority, and requires legislative action by the full New York State Legislature.
